    Default Jeff_Man got ran over update

    So i got the call. case is over and i'm only walking away with 33k. the girl only had 100k coverage and i owed blue cross 125k in med bills. laywer got it down to a 3 way split. blue cross, lawyer and i each get $33,333.33.

    I have up to 2 surgeries to go and hoping it will cover them. still hard to walk and can't even jog. the ability to lift my left foot up at the anki still has not returned and at this point will not with out a transplanted tenant from the back to the front of my leg. the pain and some numbness will never go away got life goes on.

    and no, no one can barrow money for boosting.

    couldnt you go after her property in addition to the insurance coverage she had?
    Thats a pittiful amount for the suffering you are going to be dealing with for the rest of your life.

    I would think so, depending on whether Jeff wants to put himself (and the poor girl who hit him) through all of that. I imagine that if it were up to the other driver, her insurance would pay for everything and then some, but she was not willing to pay for any higher coverage.

    Lawyers are only likely to take a case like Jeff's if the policy holder has substantial net worth. Otherwise it isn't in their financial interests.

    She has nothing, the first thing we did was a asset check and we can't go after her loaded mommy and daddy in texas. If you hire a wreck lawyer they all take 1/3 of what you get and mine is one of the best in dallas so it's still a deal and with out a lawyer i would be out ~25k from med bills so it's a win even if a small one. only other option was to try and get her to go out of pocket but she again has nothing and makes like 25K a year so not worth the lawsuit

    Glad to see you are back, I agree, might not have gotten much out of her, but at least you aren't flipping the med bills.

    That why I have un/under insured. House has 1 mill and personal and company vehicals have 1 mil.

    I was wondering the same thing. Besides if you have bluecross shouldn't you just pay the deductible and co-pay?

    Most insurance policies have a clause that allows them to recover their cost in the event you reach a monetary settlement. I suspect that the lawyer negotiated the deal with Jeff's health insurance company at the same time he negotiated the settlement with the woman's auto insurance company. If her insurance had settled for the same $100k without a lawyer involved, it is likely that Jeff's health insurance would have claimed the entire settlement. A similar case with a Walmart employee was in the news a while back.
