    If you think you are even close to being in the right you better QUICKLY file a FOIA request for a copy of the tape from the police car.

    That will prove if you are right or not. Even if you are in the wrong, the officer's attitude could still get him in some hot water.

    Its a law enforcement officer's job to be respectful and and maintain calm. Anyone who's ever met Mike knows that he's pretty laid back and respectful and would not expect him to be in this situation.

    With that said, never talk to the police. With questions like "where are you coming from," or "where are you going" come up your answer can immediately make you a suspect. Questions like this always seemed benign to me until I became a suspect in an "public masturbation" witch hunt. I matched a description of "white male in a white shirt with a black hat" and suddenly I'm informally detained and requested to appear in a line-up against my will because I have on a t-shirt, and hat among another 10-men who match the description. I never spoke, would indicate that I walked from the location of the alleged indecent exposure.

    Mike could have easily fit the description of "a motorcycle speeding down the highway," match the description, and have a felony charge right now.

    Police make their salary off creating arrest situations and are trained as vague questions and leading your response to generate arrests.

    Funny you ask...it was actually a guy masturbating in a 2nd story window. The witness who was so offended could some ID him through a 2nd story window. It turns out that DNA evidence was collected at the scene and I'm not joking.

    Although a little over-the top its solid advice. On traffic tickets I take my chances but on something criminal I take this to heart. "Wrong place, wrong time" can happen to anyone. Don't forget the incentive based arrest MO , and that each time you confer with an officer his job may depend on an ability to cite or charge with to the fullest extent possible in order to generate revenue and obtain performance based benefits like new equipment and schedule preference. When its hot out, the police are tired, and desperately need an arrest to quiet the media...you'll probably fit the description and the media won't be there when you defend yourself in court or when you're acquitted.

    If you were a cop and your boss told you that more citations and successful prosecutions were part of your performance analysis, and provided schedule preference, new squad car, and new equipment...wouldn't you arrest and cite anyone and everyone you could? Considering the "Great Recession", police are doing everything they can to keep their jobs and that means delivering criminal charges to YOU. That's probably why I have a 4mph ticket and a "changing lanes in the same motion as merging with traffic" citation. Hell, that's $250 for the court and city in about 10-minutes of work. That's also 2-points for each offense on my license and if I don't pay extra to keep it off my record I get to pay $350 per year to keep my license for the next 4-years.

    Don't talk to the cops, its a trap.

    Small update.

    Apparently what those cops did was wrong because the city is going to give me my inpound money back; and lost days wages. I'm also going to hit them up to have my record exponged. There is nothing in the city ordanance that states they tow for flat tires, therefore they can't tow ANY vehicle for a flat tire if you are there.

    The cop was a C**k Sucker and the next phase is his job and his pension, all seven of them.

    I would not do what Miatamike had done but I do have no love for the cops. If they are here 'to protect and to serve', stop harass the good folks and go after the real bad guys! What they are doing is wrong and is not helping themselves with whatever image they have left!
