Thread: Seat Belt Law question..

    Default Seat Belt Law question..

    Okay, there's something that has been bugging me. When you're driving and have a passenger in the car who is not wearing a seatbelt, can they get the ticket for it? It would seem logical that you're responsible for the safety of your passengers; after all, you're driving. But I've been hearing otherwise. Can somebody clear this up?


    BTW I always use my seatbelt and I usually don't even move my car unless the passengers are belted in.

    I'm pretty sure the driver gets the ticket. Because like you said the driver is RESPONSIBLE for everyone in the car and what they do. Example. I've got 10 lb. of crack cocain that you don't know about in my pocket. You get pulled over for driving like a damn fool, by the K-9 police truck. Dog goes wild. I ditch the crack and take off running like a Deon Sanders away from Cowboy stadium. The dog finds the crack and you go to jail.

    Sec. 545.413. Safety Belts; Offense.
    (a) A person commits an offense if the person:
    (1) is at least 15 years of age
    (2) is riding in the front seat of a passenger vehicle while the vehicle is being operated;
    (3) is occupying a seat that is equipped with a safety belt; and
    (4) is not secured by a safety belt.


    What If I take out all of the seat belts

    So from what I read, if the passanger is older than 17 than no seat belt is required.

    Yes, they can get a ticket for it. Just ask my sister-in-law.

    She didn't put hers on and refused to do it... so when my wife got pulled over, she let the cop know and the cop gave the passenger the ticket.

    Still nothing about the passengers getting a ticket though. I was wondering who would usually get the ticket... like I said, it would seem the person who is operating the vehicle..

    What If I take out all of the seat belts
    Right here it says, if you ride, not drive, you commit an ofence. Therefore, you are guilty, as the passenger, and will be ticketed. If you are the driver, you have a responcibility to assure that the passenger uses his seatbelt if that passenger is under aged, below 18 years old.

    If you don't think you need a helmet/seat belt, you're probably right.

    Then you wouldn't need them either, by sammmy's definition...

    ...just be sure to Scotchguard the interior so that the coroner can get all the bits out easily.

    Be sure and use that as your defense when the officer gives you the tickets and you go to court. And take a video camera so you can show us the reaction from the judge

    So why the stupid question MadMonkey??

    I get factory guys in town quite often that I get to drive around Texas, and I have found a good high quality brake check will normally get them to reconsider wearing a seatbelt when they ride with me.

    Then you would not pass the safty inspection the next time you took your car in.

    If the car was origionally equiped with a seat belt it must have them installed to pass inspection.
