As far as the seller giving you the runaround about whose fault it is that he thought it had a turbo...in a word, that's not your problem. Small claims court fee in Dallas county is minimal, something like $10.
Is he listed on the title as the owner? Or is it Lucky's Car Repair? I'd get as much info on him as possible, like going to www.dallascad.org enter his address and see if he is the homeowner of the address where you made the purchase, or if he is a renter. You mentioned he had other vehicles for sale on craigslist? Do a search using his phone # and see if he is selling used cars from this address.
Do these things, then get back here with results.

I know that an individual can sell only so many cars a year (3 - 5?, not sure) in Texas before he has to be licensed as a used car dealer. At that point all kinds of regulations kick in, from being bonded to having an offical lot for vehicle sales.
On a wild guess that "Joe" doesn't have a license for selling motor vehicles from this address, I would think that a few certified letters, or threat thereof, to the DMV, as well as Gladys (for running an unlicensed used car lot in a residential neighborhood) might result in a response to your concerns.
Andy, you rock. I hope this helps super skittles. Even if he doesn't get any monetary help, I hope he can make this guys life hell due to dealer fees, etc.

Excluding the missing turbo, it reminds me of an FC RX-7 my sister got conned into. 2 weeks later it needed a clutch, flywheel, and some other things. 1 month later the good old apex seals were out, ftw.
At least the Miata is cheaper to fix.

Isn't superskittles already out $300 to find out it needs major repairs? I'd be sending a certified letter to "Joe" stating my intention to file suit against him under the
Texas Deceptive Trade Practices Act seeking treble punitive damages, with a cc to his landlord (for allowing a used car lot operation on her property) and the DMV licensing dept.
I went by and got the parts from the mechanic and can see that they are all clearly messed up. I know he isnt scamming me.
the 300 I payed his is the initial check and goes towards any repairs. the repairs cost $2100 with a one year warranty.
I spent 3200 on the car. so joe giving me 500 back means it is a $2700 car.
Should I continue to demand more?

Yeah, but what about the $2100 in transmission work? I'd push for as much of that as I could...
...and +1 for what Andy said about getting all your ducks in a row with certified letters and such. I'd avoid court unless it's absolutely the last option - that would be a huge PITA, IMO.

How is there $2100 in tranny work? I used one should be had cheaper than that including install.

That really sucks though. I kinda have gone through kinda the same thing, bought my car for $5800 and 3 weeks later I lose compression due to a bad ring... new engine FTL. Top it off he never had the car registered in his name so I had to get a bonded title. Get as much money as you can skittles.
Ok so I am already apying the shop the 2100 for repairs.
Parents started that process and I cannot stop it..
If i get the $500 this friday from "Joe" I think I should ask for 500 more to pay for repairs.

Sorry about all of your trouble, but its the post like this that make me laugh when people told me my car was only worth $4,000 on some other sites.
You should either commit to the car and inform "Joe" that you will be sending him the bill for the repairs he misrepresented, which he can pay or defend himself in court, or you should sell it as-is and consider this a lesson learned.
If you do proceed with all the repairs you've described, don't count on ever recouping your money. Plan to drive the car for a good long time and get your moneys' worth, or sell it for a substantial loss.
This is the reason that its worth paying a reputable shop $100 to fully inspect a vehicle, pre-sale. The less you know about cars, the better an investment this becomes.
Odd are, "Joe" will not have enough assets to pay when he loses in court, so you'll get nickel and dimed for years, or possibly never get much of anything beyond the $500. If you do get the $500, don't sign anything other than a reciept for the $500. It will actually help your legal case if he gives you a partial refund, because it is an admission of fault. I suspect he'll keep stringing you along.
Good luck, but this is probably your learnign opportunity about "let the buyer beware." Great chance for you to build up some mechanical knowledge.
Yea you will want to edit that asap, before you get bashed even harder for that than for not knowing what a turbo looks like. Plus you are living in Texas mind you, so you need to realize that Mexicans are not a minority here.
You probably could've gotten away with "Don't buy from a Nigerian"... but, um, as generalizations go... yours wasn't the best around these parts. :rolleyes:

Court's probably an impractical option with this sort of thing. If you can't negotiate/coerce/blackmail the seller into an equitable settlement, then you should either:
A) suck it up and keep the car, or...
B) cut your losses and sell it to the next sucker. ;)
BTW, I think most of us have been fucked on a car deal, so it's nothing new. It's fun to screw with the seller and get what you can out of him, but in the end you have to consider it a hard lesson learned.

The problem isn't race, its you and your Dad's poor decision to purchase. The seller should never misrepresent the product, but its still ultimately up to you to "buy smart." Shame on you for thinking your comment is even mildly acceptable, even in the anonymity of cyberspace.
I hope for your sake that if you do go to court, you don't end up in an hispanic judges court. That was another dumb move.
