So, does the expectation of privacy extend to public roadways? I know the contents of a vehicle have been protected historically, but probable cause is pretty flimsy in most cases.
Is there a way to prevent emergency personnel from looking in your wallet for ID if they find you unconscious? Seems somewhat equivalent to checking the black box data.
Just as long as this kind of info is only useable in an accident investigation and not in law enforcement, I'm not totally opposed to the concept. Since you own the data, you could conceivably refuse to disclose it, much like a 5th amendment situation. Hmmm, I'm already contradicting myself...

What I'm betting they will do is collect the data and then when there is an accident or whatever, they'll get a subpoena for the data. This will get them around the 4th Amendment Issues.
What scares me is that I'm guessing just about all of the Insurance companies will starting having you sign away that data as a condition to be insured.

GM and others have had black boxes for a long time now, and they have been used to send people to jail for a bad accident.

Progressive tried to force my neighbors to install the tracking device in their son's car when he turned 16 and started drving. They are both lawyers and Progressive lost that fight.
A black box in any car of mine may very well go missing when I buy the car...

The data will probably be written into the ECU or some type of memory. All you need to do is erase the last minute before the incident. A dongle with a memory killer on it would do the trick.

Not if it's imbedded in the ECU that is needed for the car to operate at all. Not bloody likely they'd make it easy to disconnect.
hmmm, I think I could get rid of the data. A plasma torch does wonders to electronics.
